Charter Litigation: Affleck v. AGO

Mandate

Affleck v. AGO, 2019 ONSC 1292; Affleck v. The Attorney General of Ontario, 2021 ONSC 1108

Successfully obtained full party status for Dairy Farmers of Canada (DFC) and Dairy Farmers of Ontario (DFO) in a constitutional challenge brought by raw milk advocates to strike down federal and provincial laws prohibiting the sale and distribution of raw milk. Led expert and industry evidence in support of the federal and provincial laws, including regarding on-farm food safety protocols and best practices, and international evidence regarding the approach to raw milk regulation in other jurisdictions. The Ontario Superior Court of Justice agreed with the federal and provincial governments and DFC/DFO that the federal and provincial laws do not infringe Charter rights and, even if they did, these infringements would be justified.
